§ 2. General provisions
1. Through the Service, the Operator provides electronic services consisting of maintaining an Account, generating lyrics and music recordings using artificial intelligence, storing Songs in a private Library and, at the User's request, publishing Songs on a public share page.
2. Using the Service requires a device with Internet access, a current web browser with cookies enabled and an active e-mail address.
3. These Terms are made available free of charge in the Service in a form that allows them to be downloaded, saved and printed. The Terms are accepted when an Account is created.
4. The User undertakes to use the Service in accordance with the law, good practice and these Terms, and to refrain from supplying unlawful content.
§ 3. Account and age requirements
1. An Account is created by providing an e-mail address. Login is performed by means of a one-time link (a "magic link") sent to that address. The Service does not use passwords. The User is responsible for securing access to their e-mail inbox.
2. Only persons aged 16 or over may use the Service. Accounts of younger persons are deleted once the Operator becomes aware of the holder's age.
3. A User aged 16 or over but under 18 has limited legal capacity. A purchase of Tokens by such a person requires the consent of their legal guardian (parent or guardian), unless it falls within contracts commonly concluded in minor everyday matters (Articles 17 and 20 of the Polish Civil Code). By making a purchase, a minor declares that they have such consent.
4. The User may delete their Account at any time from the Service settings or by sending a request to hej@musify.pl. Deleting an Account removes the Songs from the Library and the Showcase. Unused Tokens are forfeited, subject to the Consumer's rights under § 8.
§ 4. Description of the service
1. A Song is created as follows:
- the User enters a Brief or pastes their own lyrics;
- a language model (Google Gemini) proposes the lyrics; the User reviews and may edit the lyrics before proceeding;
- a music model (Suno, accessed through the third-party API provider sunoapi.org operated by MIRA MUSE LLC, USA) renders two audio variants;
- the User listens to a free 30-second preview;
- the User may Unlock the Song for Tokens and then optionally order a karaoke version.
2. An Unlocked Song is available in the User's private Library and can be downloaded as an MP3 file. By default a Song is private. The User may publish a Song on a public share page and may disable that page at any time.
3. Drafting the lyrics (including the first rewrite) and the preview are free of charge. The following are paid: Unlocking a Song, the karaoke version and each additional lyric rewrite after the first free one.
§ 5. Tokens and payments
1. Tokens are purchased in packs. Pack prices are expressed in Polish zloty (PLN) as well as in US dollars (USD), euro (EUR) and pounds sterling (GBP). Prices in foreign currencies are fixed pack prices, not conversions of the PLN price. All prices are gross prices including VAT.
2. Card payments are processed by Stripe Payments Europe Ltd. The Operator does not store payment card data.
3. Tokens remain valid for 24 months from the date of purchase. After that period, unused Tokens expire. Tokens cannot be transferred to another Account or exchanged for cash, except where mandatory provisions of law require a refund (in particular § 8 and § 9).
4. The price of each paid action, expressed in Tokens, is displayed before the action is performed. As at the date of these Terms the prices are:
- Unlocking a Song (both audio variants with downloads) — 2,900 Tokens; as a launch promotion 1,900 Tokens until the date shown in the Service;
- karaoke version — 500 Tokens;
- additional lyric rewrite (after the first free one) — 50 Tokens.
5. Tokens are deducted from the Wallet only at the moment a finished Song is Unlocked (or, as applicable, a karaoke version or an additional rewrite is ordered). If generation fails for technical reasons, no Tokens are charged and any Tokens charged in error are returned to the Wallet.
6. The Operator may change prices expressed in Tokens. A price change does not affect actions already paid for and is visible before each subsequent paid action.
§ 6. Conclusion of the contract and delivery of digital content
1. A contract for the supply of digital content in the form of a Song is concluded when the User confirms the Unlock. The digital content is delivered immediately after the Unlock by making the Song available in the Library.
2. Before Unlocking, the Consumer gives express consent to performance beginning before the end of the withdrawal period and acknowledges that, as a result, they lose the right to withdraw from the contract in respect of that Song (Article 38(1)(13) of the Consumer Rights Act). The Operator sends confirmation of the contract and of this consent to the User's e-mail address.
3. A contract for the purchase of a Token pack is concluded when the payment is confirmed by the payment processor. Tokens are credited to the Wallet immediately after the payment is recorded.
§ 7. Nature of AI-generated content
1. Lyrics and recordings in the Service are generated automatically by artificial intelligence systems. They may contain linguistic, factual or stylistic errors, repetitions, inaccurate pronunciation of names, and may resemble existing works. Assessment of a Song's quality, humour and aptness is subjective.
2. The User is able to review and edit the lyrics before the recording is rendered and to listen to a free preview before Unlocking.
3. It is a characteristic of the digital content supplied in the Service that the final result may deviate from the User's expectations as to style, sound, pronunciation or fit with the Brief. The Consumer is informed of this before Unlocking and expressly and separately accepts this characteristic by ticking a separate checkbox in the Service (Article 43k(5) of the Consumer Rights Act). This acceptance covers only the artistic and substantive content of the Song; it does not cover situations where the Song is not delivered at all, is incomplete, corrupted, unplayable or does not match the ordered length or format — such cases constitute a lack of conformity of the digital content with the contract and are governed by § 9.
4. The Operator does not warrant that a Song will be unique or that a similar Song will not be generated for another User.
§ 8. Right of withdrawal
1. A Consumer who has purchased a Token pack may withdraw from that contract without giving a reason within 14 days of the date of the contract, provided that the Tokens from that pack have not been used in whole or in part. If Tokens have been partly used, the Operator refunds the amount corresponding to the unused Tokens from that pack.
2. A withdrawal statement may be submitted in any form, in particular by sending a message to hej@musify.pl. The Consumer may use the model form set out in Annex 2 to the Consumer Rights Act, but this is not obligatory. It is sufficient to send the statement before the deadline expires.
3. The Operator refunds the payment without undue delay and no later than 14 days from receipt of the statement, using the same means of payment as the Consumer used, unless the Consumer has expressly agreed to a different method of refund.
4. The right of withdrawal does not apply to a Song that has been Unlocked with the Consumer's express consent under the conditions described in § 6(2).
§ 9. Complaints and lack of conformity
1. The Operator is liable to the Consumer for the conformity of the digital content with the contract under the rules set out in Chapter 5b of the Consumer Rights Act.
2. Complaints may be submitted to hej@musify.pl. A complaint should include the e-mail address linked to the Account, an indication of the Song or transaction concerned and a description of the problem. The Operator responds to complaints electronically within 14 days of receipt. Failure to respond within this period is deemed acceptance of the complaint.
3. In the event of a lack of conformity of the digital content with the contract, the Consumer may demand that it be brought into conformity (in particular by re-generating the Song) and, if this is impossible or would involve excessive costs, may declare a price reduction or withdraw from the contract. Refunds are made to the Wallet in Tokens or, at the Consumer's request, in money to the original means of payment.
4. The Consumer may use out-of-court complaint and redress procedures, in particular by applying to the regional inspector of the Trade Inspection (Inspekcja Handlowa) for out-of-court resolution of a consumer dispute or to a permanent consumer arbitration court attached to the Trade Inspection. Information is available on the websites of the Trade Inspection and the Polish Office of Competition and Consumer Protection (UOKiK). The EU ODR platform has been discontinued and is no longer available.
§ 10. Content rules
1. It is prohibited to enter Briefs or lyrics into the Service, or to create Songs, that:
- incite hatred or violence or discriminate on the basis of any characteristic;
- harass, intimidate or demean a specific person;
- contain sexual content involving minors or explicit sexual content;
- defame or insult third parties or infringe their personal rights;
- impersonate other persons or entities or mislead as to authorship;
- infringe copyright, trade marks or other rights of third parties;
- are otherwise unlawful.
2. The User warrants that they are entitled to use the names, facts and other information contained in the Brief and that they are responsible for Songs concerning third parties, including obtaining their consent where required. When creating a Song about another person, the User should have regard to that person's dignity and privacy.
3. Before a recording is rendered, the Brief and lyrics are subject to automated moderation by an artificial intelligence system, which may refuse to generate the Song. Moderation decisions are made by automated means. The User may appeal such a decision by sending a message to hej@musify.pl; appeals are reviewed by a human.
4. The Operator may remove a Song or disable its public page, and may suspend or delete the Account of a User who breaches these Terms, notifying the User electronically with a statement of reasons unless the law provides otherwise.
5. Every Song published in the Showcase has a report button through which anyone may notify the Operator of content that is unlawful or contrary to these Terms. A person who is the subject of a Song may request its removal by writing to hej@musify.pl.
§ 11. Rights in Songs and licence
1. Songs are generated by artificial intelligence systems. Under current law, the output of such systems may not be eligible for copyright protection. The Operator makes no representation that a Song is protected by law or that the User has exclusivity in it.
2. To the extent that the Operator or its suppliers hold any rights in a Song, the Operator grants the User, upon Unlock, a non-exclusive, worldwide, perpetual licence to use the Song for personal, non-commercial purposes, in particular as a gift, at private events and in non-commercial posts on social media.
3. Use of a Song for commercial purposes — in particular in advertising, in monetised channels, in products intended for sale, or by reselling the Song — requires a separate written agreement with the Operator. Enquiries should be sent to hej@musify.pl.
4. The User grants the Operator a non-exclusive, royalty-free licence to display Songs published by the User in the Showcase and on the public share page. This licence ends when the User deletes the Song or disables its publication.
5. The User may delete a Song at any time; deletion removes the Song from the Library, the Showcase and the share page. The Operator has no control over copies previously downloaded by third parties.
6. The User retains rights in their own lyrics pasted into the Service and grants the Operator the licence necessary to render the recording and provide the services described in these Terms.
§ 12. Availability of the Service
1. The Operator endeavours to keep the Service available without interruption but does not guarantee any particular level of availability. The Operator may carry out maintenance, of which it gives advance notice where possible.
2. Provision of the services depends on third-party suppliers, in particular Google (language model), the music model API provider (sunoapi.org / MIRA MUSE LLC), Stripe (payments) and Cloudflare (infrastructure). Outages or restrictions on the part of those suppliers may temporarily prevent Songs from being generated. In such cases no Tokens are charged.
3. Nothing in this section limits the Operator's liability to Consumers under mandatory provisions of law, including liability for non-delivery of digital content or its lack of conformity with the contract.
§ 13. Liability
1. The User is responsible for the content of the Brief and lyrics and for the way the Song is used, including publication of a Song concerning third parties.
2. Towards Users who are not Consumers, the Operator's liability is limited to the amount paid by the User for Tokens in the 12 months preceding the event giving rise to the damage and does not cover lost profits. This limitation does not apply to damage caused intentionally.
§ 14. Amendments to the Terms
1. The Operator may amend these Terms for important reasons, in particular a change in the law, a change in the scope or manner of providing the services, a change of third-party suppliers or the need to counter abuse.
2. Users are notified of amendments electronically at least 14 days before they take effect. A User who does not accept the amendments may delete their Account before the effective date; until then the previous provisions apply. For Tokens purchased before the amendment, the rules more favourable to the Consumer apply.
§ 15. Final provisions
1. Contracts concluded under these Terms are governed by Polish law. This choice of law does not deprive the Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
2. Disputes with Consumers are resolved by the competent common courts under the general rules. Disputes with Users who are not Consumers are resolved by the court having jurisdiction over the Operator's registered office.
3. The processing of personal data is governed by the Privacy Policy available in the Service.
4. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in force.
5. These Terms enter into force on 2026-09-10.
